Buyer Sales Policy

1.      Definitions: In these Terms and Conditions of Sales, "Seller" means Toppa Technology International Co. Ltd., CAS Technology International, Co. Ltd. or CAS Technology (USA) Inc. depending on where Buyer place order and make payment with the Seller; The different sellers are partners and are setup for the convenience of dealing with different type of Buyers. "Buyer" means the person, firm, company or corporation by whom the order is given from. 3DPhotocase and 3DBikecase are the brands of the product that the Buyer is purchasing.

2.      Policy Coverage: This policy applies to all purchases made by buyer from us (the seller) including by internet, phone, mail or seller’s store. By placing an order, you accept and agree to be bound to the terms and conditions of this sales policy along with our Privacy, Return and Terms of Use Policy.

3.      Pricing and Price Reductions/Corrections: We, the Seller reserves the right to change prices for products at any time, and to correct pricing errors that may inadvertently occur. Our prices do not include any sales taxes, import taxes, shipping & handling charges.

4.      Products Descriptions: We, the Seller, will do our best to describe the product correctly. But we may un-intentionally, make some mistakes in our Product descriptions causing mis-understanding with the Buyer. This may include wrong pricing information. If such a situation occurs, the Seller has the right to resolve such situation by offering return and refund of products to Buyers as compensation. No other compensation beyond the purchase amount will be offered by us, the Seller.

5.      Warranty & Returns & Refund:  We, the Seller only warrant our product to directly purchaser for a period of one (1) year. All product returns must have a Return Merchandising Authorization Number (RMA#) from us before any product can be returned. For more details, please read our separate Warranty & Return Policy. All Refund must be approved by our Seller after inspection of the returned products. Not all products are refundable due to Purchaser usage and no longer in sellable conditions. The maximum refund or compensation for any purchase will not exceed the amount of the purchase.

6.      Order Acceptance/Confirmation: We, the Seller, in its sole discretion, can refuse or cancel any order and limit order quantity. We may also require additional qualifying information prior to accepting or processing any order. Once we receive your order that was placed on our website or directly with our sales staff, we’ll provide you, the buyer with an email order confirmation. Only after an email confirmation, then the order will be considered accepted with the correct pricing & discount by us the Seller. We may refuse your order if we think that you are buying our product for resales without our acceptance as our authorization reseller. Resellers are covered by a different reseller agreement.

7.      Payment and Credit Terms: All purchase will be in US dollars unless otherwise stated by the Seller. All consumer, end-buyer sale’s payments are 100% at the time of order is placed. Credit terms are only offered to reseller who purchase in bulk.

8.      Taxes: Buyer is responsible for all sales taxes and import taxes.

9.      Discount Coupons: Our discount coupons are limited time and applicable to certain products only.  Please read our Discount Coupon Policy for full details.

10.  Shipping & Delivery:

10.1.        Shipping & handling charges are paid by Buyer and the amount will depend on the shipping method selected by the Buyer. The shipping charge may be very high since we ship directly from our China factory.

10.2.        Unless otherwise stated in Seller's order confirmation, all periods stated for delivery or completion run from the Effective Date and are to be treated as estimates only not involving any Sales Order obligations. Since the actual delivery of your order can be impacted by many events beyond our control once it leaves our facilities, the Seller cannot be held liable for late deliveries. We will, however, work with you to ensure a smooth delivery. Because our products are manufactured outside of USA, delivery time of one month or more is possible.

11.  Gift Certificates:

11.1.        Usages: Our Gift Certificates are for our customers to purchases as gift to their friends. The Gift Certificates can only be used to purchase products from our website ONLY.

11.2.        Liability: Un-used balance of our Gift card will not be refunded, and Gift Certificate Purchaser agreed that any un-used balance will be giving to us, the Seller without compensation.

11.3.        Nonreturnable: Notwithstanding anything contained in these Terms and Conditions, Our Gift Certificate in printed or electronic format are not returnable or refundable for cash.

11.4.        Not for Resale: Resale of our Gift Certificate is strictly prohibited.

11.5.        Lost or Stolen Gift Certificate: Lost or stolen Gift Certificate will not be replaced.

11.6.        Expiration: Gift Certification will expire 5 years after it is issued.

11.7.        Applicable Laws: Gift Certificates are governed under the laws of the country in which is being used. For internet purchase, it will be governed under Hong Kong, SAR China by default.

12.  Sales Liability: The maximum Seller liability for any sales dispute will not exceed the   sales order dollar amount.

13.  Governing Laws:

13.1.        If purchases are made with CAS Technology (USA) Inc., the Seller USA entity, then the followings terms apply. To the extent they are not pre-empted by federal law, this Sales Policy shall be governed by and construed in accordance with the laws of the State of California, exclusive of its choice of law rules. Each party to these Terms and Conditions of Sale submits to the exclusive jurisdiction of the state and federal courts sitting in San Jose, in the State of California, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. 

13.2.        If purchases are made with Toppa Technology International Co. Ltd., or CAS Technology International, Co. Ltd. then this Sales Policy shall in all respects be construed in accordance with the laws of Hong Kong, SAR China. shall be without regard to any conflict of laws or rules which might apply the laws of any other jurisdiction. All disputes arising out of the Sales Order/Agreement shall be subject to the exclusive jurisdiction of the laws of Hong Kong, SAR China. Internet sales via our website are covered under this regulation.

13.3.        In any action to enforce these Terms and Conditions of Sale, the prevailing party shall be entitled to costs and attorney fees.

13.4.        In the event that any of the Terms and Conditions of Sale are held by a court or other tribunal of competent jurisdiction to be unenforceable, those provisions shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect.
